The High Court has asked the government to explain why an order to conduct a land survey in Chittagong Hill Tracts to stop land disputes should not be issued.
The cabinet division secretary, law secretary, CHT secretary and 10 others have been asked to explain to the court within 12 weeks.
The bench of justices Farid Ahmed and Mohammad Shawkat Hossain issued the rule on Monday following a writ filed by CHT residents Mohammad Jahangir Kamal and AHM Shahidullah.
Lawyer Monzil Morshed stood for the petitioner during the hearing.
He told the court that the CHT Land Dispute Settlement Commission on August 3, 2009 decided to conduct survey in three districts. As per law, it was compulsory for the administration to implement the decision, he said.
‘But the administration is yet to implement the decision,’ Morshed added.

The High Court issued a rule upon the government on Monday to explain within 12 weeks why it should not be directed to hold a land survey in three districts of Chittagong Hill Tracts (CHT) in line with a CHT Land Commission decision.
The HC bench of Justice Farid Ahmed and Justice Md Shawkat Hossain came up with the rule after hearing a writ petition filed by two CHT locals.
Jahangir Kamal and AHM Abdur Rashid filed the petition in the form of public interest litigation in January this year seeking directive from the HC on the government to hold a land survey in three CHT districts – Khagrachhari, Bandarban and Rangamati.
Petitioners’ counsel Manzill Murshid told the court that the CHT Land Commission on August 3, 2009 decided to conduct a land survey in the CHT districts, and asked the government authorities to implement its decision within six months.
But the government has not taken any step to hold the land survey although the government is bound to implement the decision of CHT Land Commission as per relevant laws, he said.
Attorney General Mahbubey Alam opposed the petition, saying that holding survey in the CHT area is a political decision of the government.
